The European Chemicals Directive (REACH) came into force on 1 June 2007. For so-called phase-in materials, the phase for preregistration, which grants transitional periods for the actual registration, ended on 30 November 2008.
Our products consist predominantly of natural substances. We mine them from our own deposits and at our plants they are processed to create our well known products by means of physical treatments. These natural substances are exempt from the obligation to be registered. We pre-registered those of our substances liable for registration in a timely fashion and registered them by 1 December 2010. Our suppliers too have confirmed to us that all our purchased substances comply with REACH.
The products we make available to our customers therefore meet statutory requirements and our customary high quality standards.
We not only provide safety data sheets for products where this is required by law, but do so for all our products. These safety data sheets are already designed to comply with REACH and we constantly bring these documents up to date. However, the registration numbers can only be communicated after the European Chemicals Agency (ECHA) has issued these numbers. As soon as these registration numbers are available, we include them in our current safety data sheets. For our purchased raw materials, however, this may even take until 2018 due to the varying transitional periods. The EINECS and CAS numbers of the components of our products can be found in our safety data sheets.
The preregistration numbers are a communication tool between the registrant and ECHA. Thus we will not communicate these numbers along the supply chain. Nonetheless, a preregistration number alone is no guarantee that a substance conforms to REACH. However, as a customer you can, of course, always depend on K+S KALI GmbH only supplying you, as previously, with products that fully meet all legal requirements and therefore also comply with REACH.
In creating safety reports, we will naturally take into full consideration this intended use for our fertilizers. For our products from the areas Industry, Health Care & Food and Feed, there will be no requirement to specify identified uses and exposure scenarios, since they do not contain any substances classified as hazardous. We will, of course, specify their applications as general purposes of use to the extent that they are known to us. We welcome information about this from you.
The new European Chemicals Directive No. 1907/2006 (REACH) came into force on 1 June 2007. Its purpose is the registration, evaluation and authorisation of chemical substances. Additionally, REACH also includes regulations on the restriction of substances and the approval of particularly worrying substances.
The aim of the directive is to ensure a high level of protection for human health and the environment and contribute to boosting the confidence of consumers and society as a whole in the chemicals industry. At the same time, REACH is intended to improve the ability of the European industry to compete and innovate and to consolidate its position on global markets.
For example, it provides for the registration of all substances produced in or imported into the EU with a quantity of > 1 t a-1. In the framework of this registration, the safety of the respective substance has to be demonstrated for all identified uses. This is done through the submission of a registration dossier to the new European Chemicals Agency (ECHA) in Helsinki. It will manage the registration process and ensure uniformity across the EU.
REACH provides for transitional periods of from three-and-a-half to 11 years for the registration of substances that are already on the market. To qualify for this, these substances had to have been pre-registered between 1 June 2008 and 30 November 2008. Our products, whose annual production volume exceeds 1,000 tonnes, then had to be registered under REACH by 1 December 2010, as in the case of the products marketed by us.
